In downtown Indianapolis land, which sits in the Chatham-Arch and Massachusetts Avenue, Historic Preservation District was previously, zoned SU-7, which means only charitable, philanthropic, and not-for-profit use is permitted.
David Pflugh, a local resident, and attorney, who lives across the street sued the city entities, for the approved zoning project, Chatham Park development. The area was recently rezoned to D-8 to allow for the development of one small commercial use and four development-standard variances, and certificate of appropriateness, according to The Indiana Lawyer.com
Pflugh petitioned for judicial review of the grant of variances and the certificate of appropriateness. However, Marion Superior Court denied his petition, stating he lacks standing to challenge the Indianapolis Historic Preservation Commission’s (IHPC) rezoning decision.
The case is David Pflugh v. Indianapolis Historic Preservation Commission sitting as the Indianapolis Historic Preservation Commission and as the Board of Zoning Appeals Division of Marion County, Indiana et al., 18A-PL-351.
