Investors:Excessive Fines and Penalties Prohibited by Supreme Court
Great news for Investors. The US Supreme Court held that excessive civil fines and penaltes are not allowed. This has a direct application for Investors that are being fined as part of the rental inspection programs in various cities.
Let us know if your city is imposing fines that are out of proportion to the penalty. The Court found that our 8th Amendment applies to the states and even went back 800 years to trace the importance of this law to Magna Carta in the year 1215. The Court even noted that governments have a tendency to impolse fines and undermine other liberties such as retaliating against political enemies or chill the speech of enemies.
